Supreme Court Blocks Foreign Aid Spending: A Victory for Trump

In a significant decision, the Supreme Court has granted the Trump administration the ability to withhold $4 billion in foreign aid that was previously approved by Congress. This ruling effectively halts a lower court order that mandated the administration to disburse the funds by the end of the month.

The Supreme Court's brief order stated that the government had demonstrated a "sufficient showing" that the groups challenging the withholding lacked the legal standing to bring the lawsuit under the Impoundment Control Act. The court, currently with a 6-3 conservative majority, also emphasized that the potential harm to the Executive Branch's conduct of foreign affairs appeared to outweigh the potential harm to the plaintiff groups, which are recipients of the foreign aid funds.

This decision marks the 20th emergency application filed by the Trump administration that the Supreme Court has granted since the beginning of his second term in January. The sheer volume of these emergency filings, combined with the high success rate for the administration, has drawn criticism from legal experts and even lower court judges.

Dissenting Voices

The court's three liberal justices dissented from the ruling. Justice Elena Kagan argued that the legal issue in the case was novel and that the court was venturing into "uncharted territory." She criticized the majority for granting the emergency request without the benefit of oral arguments or a fully reasoned decision.

"We therefore should have denied this application, allowed the lower courts to go forward, and ensured that the weighty question presented here receives the consideration it deserves," Kagan wrote.

Chief Justice John Roberts had previously issued a temporary stay on September 9, putting the lower court ruling on hold. This latest decision solidifies the administration's ability to control the disbursement of these funds.
