As his son, Matt Durkin, stated, his father “really believed in the principle that everyone, no matter how derided you are, you are owed your constitutional right to defense.” This conviction led him to represent individuals accused of terrorism, civil rights violations, and other high-profile crimes.

He represented Adel Daoud, convicted of plotting a terror attack in Chicago, and several Guantanamo Bay detainees, including one accused of involvement in the 9/11 attacks. He also raised concerns about the potential for a “two-tiered system of justice” after representing a Lombard teen accused of trying to join ISIS, noting the disparate treatment of American Muslims in the courts.
