The Black Lawyers Association (BLA) has voiced strong condemnation over the composition of the Madlanga commission of inquiry, labelling the exclusive appointment of advocates as evidence leaders, while excluding attorneys, as "shocking, embarrassing, and discriminatory". This concern stems from a perceived missed opportunity to empower attorneys within the legal profession.

BLA's Letter to Judge Madlanga

In a letter addressed to Judge Mbuyiseli Madlanga, the BLA expressed its disappointment following the announcement of the commission's team of professionals. Takalani Chris Mamathuntsha, secretary-general of the BLA, highlighted the lack of consultation with the association's leadership regarding the team's composition.

Mkhwanazi Claims Trigger Probe

President Cyril Ramaphosa established the commission to investigate allegations of criminality, political interference, and corruption within the criminal justice system. These allegations arose from explosive claims made by KwaZulu-Natal police commissioner Lt-Gen Nhlanhla Mkhwanazi, who accused Police Minister Senzo Mchunu of interfering with police investigations, specifically regarding the disbandment of the political killings task team.

Parliamentary Committee to Investigate

Adding to the ongoing investigations, a parliamentary ad hoc committee is also convening to probe Mkhwanazi's claims. This eleven-member panel, comprised of proportional party representatives, is tasked with reporting back to the National Assembly by October 31st. Their investigation will include examining the controversial disbanding of the Political Killings Task Team by Minister Mchunu.

Attorneys' Contribution to Jurisprudence

Mamathuntsha emphasized the significant contributions of attorneys to South Africa's jurisprudence, particularly since the democratic elections. He noted the availability and service of BLA and National Association of Democratic Lawyers members within the judiciary, highlighting their presence in all superior courts.

Ad Hoc Committee Elects Chairperson

The ad hoc committee formed to investigate Mkhwanazi's claims held its first meeting on Tuesday to elect a chairperson. The committee's formation follows serious allegations leveled by KZN Police Commissioner Lieutenant General Nhlanhla Mkhwanazi, implicating Minister Mchunu, politicians, and even members of the judiciary.
