Eastern Cape Judge President Selby Mbenenge has vehemently denied allegations of sexual harassment, claiming they are “lies” and part of a campaign to discredit him. He took the stand on Monday in a months-long tribunal addressing the accusations made by Andiswa Mengo, who alleges that Mbenenge exposed himself to her.

Mbenenge refuted the allegations, stating, “It is lies, it never happened,” referring to the alleged incident on November 15, 2021. He maintains that he had no interaction with Ms. Mengo during the relevant timeframe. His testimony included details of his activities that day, including attending a judicial staff meeting, visiting the bank, and delivering a lecture to students.

According to Mbenenge, his car tracker data supports his alibi, demonstrating his movements throughout the day and contradicting Mengo's claims. He presented this evidence as proof that he was not at the high court during the time of the alleged incident.

Addressing further allegations of impropriety, Mbenenge defended his right to engage in a romantic relationship with a junior colleague, emphasizing that he was not her supervisor or employer. He clarified that Mengo is employed under the Public Service Act, while he is a member of the judiciary, highlighting the distinction in their roles.

Mbenenge also denied sending nude photographs or making lewd comments to Mengo. He explained that his remarks about her clothing were related to courtroom decorum and were not intended to be sexually suggestive. He pointed out that Mengo initially stated in her affidavit that the comments did not offend her.

The tribunal, headed by former Gauteng judge president Bernard Ngoepe, continues to hear evidence in this complex and highly publicized case. The outcome of the tribunal will have significant implications for Mbenenge's career and the reputation of the judiciary.
