Madlanga Commission Controversy: Attorneys Snubbed! Is Justice Served?
The Black Lawyers Association (BLA) has voiced strong objections to the composition of the Madlanga commission of inquiry, citing the exclusion of attorneys as evidence leaders as “shocking, embarrassing and discriminatory.” The commission, appointed by President Cyril Ramaphosa, is tasked with investigating allegations of criminality, political interference, and corruption within South Africa's criminal justice system, following explosive claims made by KwaZulu-Natal police commissioner Lt-Gen Nhlanhla Mkhwanazi.
Mkhwanazi accused police minister Senzo Mchunu of interfering with police investigations and overstepping his authority by ordering the disbandment of the political killings task team. These serious allegations prompted the formation of both the Madlanga commission and a parliamentary ad hoc committee.
BLA's Concerns: A Missed Opportunity for Empowerment
Takalani Chris Mamathuntsha, secretary-general of the BLA, expressed disappointment that the association was not consulted on the composition of the team assisting the commission. He emphasized the significant contributions attorneys have made to South Africa's jurisprudence, particularly in the judiciary. According to Mamathuntsha, excluding attorneys represents a missed opportunity to empower the profession.
Parliamentary Committee Also Investigating Mkhwanazi Claims
Meanwhile, the parliamentary ad hoc committee probing Mkhwanazi's claims is set to elect its chairperson. This eleven-member panel, comprised of proportional party representatives, has a deadline of October 31st to report back to the National Assembly. Their investigation will also focus on the disbanding of the Political Killings Task Team by Minister Mchunu.
The BLA's critique adds another layer of complexity to the already sensitive investigation. The composition of investigative bodies and the perceived fairness of the process are crucial for maintaining public trust in the pursuit of justice.
